Būtiskākās problēmas piedziņas vēršanas uz nekustamo īpašumu procesā

Bakalaura darbs tika izstrādāts, kā sekas pašreizējai ekonomiskai situācijai un pēdējām izmaiņām piedziņas vēršanas uz nekustamo īpašumu procesa tiesiskajā regulējumā. Darba mērķis ir noskaidrot būtiskākās problēmas piedziņas vēršanas uz nekustamo īpašumu procesā veicot tiesiskā regulējuma, zvērināto tiesu izpildītāju un tiesu prakses, kā arī zinātnisko atziņu analīzi. Krievijas Federācijas tiesiskais regulējums tika izmantots salīdzināšanas nolūkā. Autors darbā izdara vairākus secinājumus un izsaka priekšlikumus Latvijas piedziņas vēršanas uz nekustamo īpašumu tiesiskā regulējuma pilnveidošanai. Par svarīgāko priekšlikumu ir uzskatāms ierosinājums ieviest obligāto nekustāmā īpašuma apraksti. The bachelor work was developed as the consequence to the current economical situation and legal regulations in the field of execution against the real property. The aim of the work is to figure out the main problems in the process of the levy of the execution on the real estate on the basis of analyse of the legislation, praxis of certified bailiffs and courts, scientific research. Also legal regulations of the Russian Federation are used in order to compare the situation. In the work author gives some conclusions regarding problems and proposals regarding the improvement of the Latvia’s legal regulation in the levy of the execution on the real estate. The most serious of them can be considered the one regarding introduction of the obligatory distress of the real estate.
