Krimināltiesības ir sarežģīta tiesību nozare, kas satur dažādus tiesiskuma nosacījumus. Darbā tika izmantoti Latvijas un ārvalstu tiesību akti, mācību grāmatas un speciāla literatūra, tiesu prakses materiāli. Nepieciešamā aizstāvēšanās ir ne tikai cilvēka subjektīvā tiesība, bet arī pienākums. Darbā ir analizēts nepieciešamās aizstāvēšanās jēdziens un tiesiskuma nosacījumi. Nepieciešamā aizstāvēšanās satur attiecībā uz uzbrukumu, tā arī uz aizstāvēšanos. Uzbrukumam ir jābūt pastāvošam, pretlikumīgam, reālam. Savukārt aizstāvēšanās jābūt vērsta uz likumīgu interešu aizsardzību; kaitējums nodarīts tikai uzbrucējam; nav pārkāptas nepieciešamās aizstāvēšanās robežas. Nepieciešamā aizstāvēšanās paredz ne tikai savu interešu aizsardzību, bet arī citu cilvēku. The Criminal law is a complicate system of law, which enters different legal provisions. The work is written, analysing legislation of Latvian and other countries, researching special law literature in Latvian, English, Russian, French and Ukrainian, and legal practice from Latvia and Ukraine. The work defines essence of the self-defence, legal conditions of self-defence. The necessary defence can be also as a human’s right, as a duty. Self-defence contains certain conditions of an attack and protection. The attack should be real, illegal and existing. Conditions of lawful protection should be the following - protection of legitimate interests, the rights; harm should be put only attacking; observance of limits of necessary defence. Self-defence grants the right not only to protection of the legitimate interests, but also other people.
