Abstract

Bakalaura darba ietvaros analizēts būvniecības ieceres publiskās apspriešanas tiesiskais regulējums, izvērtējot gan Satversmē ietvertās tiesību normas, gan likumos un likumpakārtotajos tiesību aktos, kā arī Satversmes tiesas un Augstākās tiesas Senāta Administratīvo lietu departamenta spriedumos ietvertās atziņas par būvniecības ieceres sabiedriskās apspriešanas regulējošo tiesību normu interpretāciju. Darbā īpaša uzmanība pievērsta Būvniecības likumā ietvertajiem obligātajiem priekšnoteikumiem, kuriem iestājoties rīkojama būvniecības ieceres publiskā apspriešana. Balstoties uz normatīvajos aktos ietverto būvniecības ieceres publiskās apspriešanas tiesisko regulējumu un tiesu praksē paustajām atziņām, darbā piedāvāti ierosinājumi būvniecības ieceres publiskās apspriešanas tiesiskā regulējuma uzlabošanai.

Subject of bachelor’s thesis “The legislation of the public discussion of the construction intention” is to analyze the legislation of the public discussion of the construction intention appraising both the legal provisions included in the Constitution, and laws and law subordinated legislation also cognitions included in the judgments of Constitutional court and Supreme’s Court Department of Administrative Cases about interpretation of provisions adjusted the public discussion of the construction intention. Author in the thesis focuses on the obligated preconditions included in the Constructions law under which the public discussion of the construction intention must be held. Basing on the legislation of the public discussion of the construction intention included in the legal acts and case law the thesis also contains the proposals for improvements of the legislation of the public discussion of the construction intension.
