Noziedzīgi iegūtā netraucēta lietošana nav savienojama ar tiesiskas valsts izpratni. Visās demokrātiskās un tiesiskās valstīs pastāv regulējums noziedzīgi iegūtā atsavināšanai, atšķirības pastāv tikai pielietotajās metodēs, kā noziedzīgi iegūtais tiek personai atsavināts. Lai varētu šīs metodes efektīvi piemērot, ir jābūt skaidrai izpratnei par to, ko var uzskatīt par noziedzīgi iegūto, kā to izskaitļot un kā personai liegt noziedzīgi iegūtā izmantošanu. Bakalaura darba mērķis ir, studējot tiesisko regulējumu, juridisko literatūru un tiesībsargājošo institūciju prakses materiālus, apskatīt un izpētīt noziedzīgi iegūtu līdzekļu jēdzienu un atspoguļot tā svarīgākos aspektus, izpētīt noziedzīgi iegūtu līdzekļu vērtības noteikšanas procesa īpatnības, kā arī apskatīt procesu par noziedzīgi iegūtu mantu. The use of illegally gained is not compatible with the legal principles of a state. In every democratic and lawful state there is a mechanism which allows to confiscate illegaly gained, which in almost every case is proceeds from crime. For an effective enforcement of these mechanisms, there should be a concept of proceeds from crime that is general and applicable to all states. In this bachelor’s paper the author is analysing the whole concept of proceeds from crime and gives suggestions on what should be done in the future. This work contains three chapters. The first is the chapter in which the author tries to analyse the term „proceeds from crime” basing the analyse on legal text research. In the second chapter author deals with the problematic question on how to determine the value of proceeds from crime. In Latvia there is no legal regulation for this subject, so author is researching on what based regulations and how in theory and in practise the calculation of proceeds from crime works. In the third chapter author views and explains the process of criminal property. In the conclusion of bachelor’s paper author gives conclusions based on this research.
