Saskaņā ar Latvijas Republikas Civillikuma ģimenes tiesību normām, adoptētajam būtu jābūt tādām pašām tiesībām uz adoptētāja un viņa radinieku mantojumu, kādas tās ir adoptētāja bioloģiskajiem bērniem, tomēr, izvērtējot pašreizējo mantojuma tiesību regulējumu, tas tā nav.
Civillikuma adopcijas regulējums šobrīd paredz iespēju adoptēt tikai nepilngadīgu personu, bet agrāk bija iespēja adoptēt arī pilngadīgas personas. Pilngadīgas personas adopcijai likumā bija paredzētas atšķirīgas tiesiskās sekas, un personu loks, uz kurām tās attiecas, bija šaurāks. Vēsturiski likumā šo personu mantošanas kārtību regulēja CL 401. pants, kurš paredzēja ievērojami šaurāku mantošanas tiesību apjomu nekā adoptētāja bioloģiskajiem bērniem. Izslēdzot iespēju adoptēt pilngadīgu personu, zuda šī panta nozīme, tomēr tas tika atstāts negrozīts. Gan tiesiskajā regulējumā, gan praksē tas ir pretrunā ar adopcijas pamatprincipiem, un to būtu nepieciešams steidzami grozīt.

The adoption regulations of the Civil Law now makes it possible to adopt only a minor, but in the past there was a possibility to adopt also an adult person. In the law about adoption there were provided different legal consequences to an adult person, and the range of persons to which it relates was narrower. Historically, these persons’ order of inheritance in the law was regulated by the 401st article of the Civil Law, which provided a significantly narrower amount of inheritance rights than the adoptive parents’ biological children. Excluding the possibility to adopt an adult person lost the meaning of the 401st article, however it was left unchanged. Both the legislation and in practice, it is contrary to the fundamental principles of adoption, and it should be changed as soon as possible.
