Atsevišķās aizgādības tiesību un saskarsmes tiesību regulējums Latvijas Republikā

Abstract

Kā bakalaura darba tēmu autore ir izvēlējusies divu tiesību institūtu - atsevišķās aizgādības tiesību un saskarsmes tiesību regulējumu Latvijas Republikā. Darba mērķis ir analizēt un izpētīt abu iepriekš minēto tiesību institūtu normatīvo regulējumu, praktisko piemērošanu, kā arī konstatēt iespējamās problēmas un piedāvāt to risinājumu. Lai sasniegtu darba mērķi, autore ir iepazinusies ar spēkā esošo šo tiesību institūtu normatīvo regulējumu, pētījusi tiesu praksi un juridiskajā literatūrā sniegtās atziņas. Atsevišķās aizgādības tiesību un saskarsmes tiesību institūtu izpētes rezultātā autore ir secinājusi, ka praksē nepastāv vienota izpratne par abu tiesību institūtu būtību un līdz ar to nav arī vienotas izpratnes par attiecīgo tiesību normu piemērošanu. Tādējādi netiek nodrošināta efektīva tiesību piemērošana. Tādēļ darba autore ir rosinājusi veikt nepieciešamās izmaiņas spēkā esošajos normatīvajos aktos. Ar bakalaura darbu autore vēlas iesākt abu šo tiesību institūtu tiesiskā regulējumā pilnveidošanas un attīstības procesu nolūkā izslēgt pastāvošās normatīvo aktu kolīzijas un neskaidrības to piemērošanā praksē.

The Theme of Bachelor’s Paper is The Legal Regulation of the Separate Custody an Access Rights in the Republic of Latvia. The purpose of Bachelor’s Paper is to analyze the legal Regulation of Separate Custody and Access Rights institutes, the practical application, as well as to identify potential problems and propose solutions. To accomplish the purpose of Bachelor’s Paper the author has reviewed the existing law of institutes, studied the case law and the legal advice given in the literature. Author concludes that in practice there is no uniform understanding of both legal institutions. Author has proposed to introduce certain amendments in the legal regulation to improve the legal protection and law enforcement. The Paper consists of five chapters and the research results are included in the summary.
