Bakalaura darba mērķis ir noskaidrot, kādas ir uztura līguma izpratnes un pielietošanas problēmas teorijā un praksē.
Lai īstenotu izvirzīto mērķi tiek analizētas uztura līguma normatīvā regulējuma problēmas, kā arī piedāvāti iespējamie risinājumi, ņemot par piemēru Lietuvas, Igaunijas, Vācijas un Šveices pieredzi, kuru pamatā ņemts šo valstu uztura līguma un tam pielīdzināmo līgumu tiesiskais regulējums. Tāpat darbā konstatētas un izanalizētas uztura līguma raksturīgākās praktiskās problēmas Latvijas Republikas tiesu nolēmumos.
Autore secina, ka nepieciešams uztura līguma tiesiskā regulējuma uzlabojumi sakarā ar tā formu, no līguma izrietošajām ķīlas tiesībām, kā arī uztura došanas pienākuma termiņiem. The aim of the Bachelor Paper is to ascertain what is the purpose of the maintenance contract and its application probelms in theory and practice.
To reach the posed aim the problems of the legislative regulations of the maintenance contract were analysed as well as possible solutions were proposed modelling the experience of Lithuania, Estonia, Germany and Swicerland where the legislative regulations of maintenance contracts and equal to them contracts were considered. Moreover, the most characteristic practical problems in the rulings of the court of the Republic of Latvia of the maintenance contracts were stated and analysed in the Paper.
The Author concludes that the improvements on legislative regulations of the maintenance contracts are necessary because of its form, consequent from the contract legal liens, as well as liability terms of maintenance provision.
