Latvijas un Francijas komercdarījumu regulējums

Abstract

Maģistra darba tēma ir „Latvijas un Francijas komercdarījumu regulējums”. 2008.gada 18.decembrī tika pieņemti grozījumi Komerclikumā, t.sk., arī Komerclikuma D daļa par komercdarījumiem. Turpmāk tiesiskiem darījumiem, kas tiek slēgti starp komersantiem tiks piemērots komercdarījumu regulējums, daļa no komercdarījumu regulējuma tiks piemērots arī darījumiem starp komersantiem un nekomersantiem. Vienlaicīgi komercdarījumiem tiks piemērot Civillikuma noteikumi par tiesiskiem darījumiem tiktāl, cik Komerclikums nenoteiks citādāk. Maģistra darbā ir apskatīta daļa no komercdarījumu vispārīgajiem noteikumiem, salīdzinot ar Francijā pastāvošo regulējumu, apskatīt komercdarījumu jēdzienisko saturu, tā veidus, noskaidrot vienpusēju un divpusēju komercdarījumu jēdzienu saturu un specifiku normatīvo aktu piemērošanā.

Theme of the present Master paper is “Regulation of commercial transactions of Latvia and France”. On 18 December 2008 amendments in the Commercial Law (including Part D on commercial transactions). These amendments stipulate that regulation of commercial transactions would be applied to lawful transactions between traders; part of the regulation of commercial transactions would be applied to transactions between traders and non-traders. At the same time to all the commercial transactions the regulations on lawful transactions of the Civil Law will be applied, unless the Commercial Law provides differently. The goal of the Master paper is to view part of the general requirements of commercial transactions comparing to regulation effective in France, examine the conceptual idea of commercial transactions, types of commercial transactions, to comprehend concepts of unilateral and bilateral commercial transactions and the specific features in applying normative acts.
