Maģistra darba nosaukums ir „Tiesību normas iztulkošanas un tiesību tālākveidošanas nošķiršana”.
Autore par darba mērķi izvirzīja noteikt tiesību normas iztulkošanas un tiesību tālākveidošanas metodes un noteikt kritērijus, pēc kuriem nošķirt tiesību normas iztulkošanu un tiesību tālākveidošanu.
Pirmajā nodaļā autore apskata tiesību normas iztulkošanas metodes un autore secina, ka tiesību normas iztulkošana veicama ar intra legem.
Otrajā nodaļā autore apskata tiesību tālākveidošanas metodes un secina, ka tiesību tālākveidošanas metodes ir analoģija, teleoloģiskā redukcija, praeter legem un contra legem.
Trešajā nodaļā autore apskata tiesību normas iztulkošanas un tiesību tālākveidošanas nošķiršanas kritērijus.
Autore secina, ka likuma roba izpratne ir apskatāma plašākā un šaurākā nozīmē. Likuma robs šaurākā nozīmē ir likumam un likuma teleoloģijai pretēja nepilnība, kas ietver tikai īstos robus. Savukārt, likuma robs plašākā nozīmē ietver visus likuma robus, gan īstos, gan šķietamos. Autore secina, ka nošķišanas kritēriji ir iedalāmi noteicošie un sekundārie. Noteicošie kritēriji ir: tiesību normas teksta robežas, kritērijs – vienkārša vai sarežģīta lieta – , tiesību jaunrades pakāpe un likuma roba (plašākā nozīmē) aizpildīšana. Sekundārie kritēriji ir: kritērijs - likumimanents vai likumu pārsniedzošs rezultāts – un likuma roba (šaurākā nozīmē) aizpildīšana. The title of the Master's paper is “Separation of interpretation and further development of law”.
The author set the following goals of the paper: to determine methods of interpretation and further development of law and to establish criteria according to which to separate interpretation and further development of law.
In the first section the author surveys the methods of interpretation of law and the author concludes that interpretation of law should be performed with intra legem.
In the second section the author surveys the methods of further development of law and concludes that methods of further development of law are analogy, teleologic reduction, praeter legem and contra legem.
In the third section the author surveys the separation of interpretation and further development of law.
The author concludes that understanding of the gaps in the law must be viewed in a wider and narrower sense. In the narrower sense a gap in law means an insufficiency which is adverse to the law and law teleology which includes only the real gaps. But in the wider sense a gap in law involves all gaps in the law, both the actual and implied. The author concludes that separation criteria are to be divided as decisive and secondary. The decisive criteria are: text limits of the law, criteria – a simple or complex case -, the level of law development and filling of the gap in the law (in wider sense). Secondary criteria are: a result overpowering the law – and filling of the gap in the law (in narrower sense).
