Darbs aplūko bāriņtiesas kā vecāku un bērnu attiecību publiska vidutāja kompetenci Latvijā, analizējot bāriņtiesas normatīvās pilnvaras un likumdevēja deleģējumu attiecībā uz iejaukšanos vecāku un bērnu attiecībās. Darba pirmajā daļā tiek analizēts ģimenes institūta, vecāku un bērna jēdziens, kā arī tiek aplūkots attiecīgais normatīvais regulējums. Otrajā daļā autore pievēršas publiskās iejaukšanās koncepcijām, mediācijas analīzei, kas ietilpst publiskās „intervences” būtībā. Mediācija tiek apskatīta kā process, kas pašlaik Latvijā attīstās, nevis vienīgi kā konkrēts pakalpojums, kurš tiek sniegts Rīgas domes Rīgas bāriņtiesā, jo mediācija apriori ir plašāks jēdziens, nekā Latvijā pieņemts uzskatīt, ko autore arī norāda un analizē darbā. Darba otrajā daļā tiek aplūkots bāriņtiesas normatīvais regulējums attiecībā uz noteikto funkciju apjomu, savukārt darba trešā nodaļa ir veltīta aktuālajām problēmām, kas ir novērojamas bāriņtiesu un tiesu darbā attiecībā uz jautājumiem, kas izriet no vecāku un bērnu, kā arī vecāku savstarpējām attiecībām, un ir saistītas ar bāriņtiesas kompetenci. Kopsavilkumā darba autore sniedz secinājumus un izvirza priekšlikumus.
Autore secina, ka mūsdienās par ģimeni būtu jāuzskata arī tās ģimenes, kuras nav pilnas, vai tās, kur nav pēcnācēju, jo ģimenes ir mainījušās kvantitatīvi, mūsdienās ģimeni veidos arī viens vecāks ar bērnu. Sabiedrībā, arī juristu aprindās tiek pausts maldīgs viedoklis, ka Latvijas normatīvajos aktos netiek regulēts jautājums, kā piespiest vecākus atzīt un pildīt likumā un ar tiesas spriedumu noteikto otra vecāka saskarsmes tiesības izmantošanu. Tas absolūti neatbilst reālai tiesiskai situācijai un normatīvajam regulējumam valstī. The master work “The Family Court as a Public Mediator of Parents and Children Relationship in Latvia” is elaborated by the law student of the University of Latvia Julia Ivanova.
The work is dealing with the family court as a public mediator of parents and children relationship in Latvia, analyzing the normative scope of the family court and it’s as by legislator delegated possible intervention in family relationship. The first part of the work examines the definition and conception of the institute of family, parents and children given in different source – law dictionaries, in sociology and jurisprudence, international conventions and declarations and in laws of Latvia. The second part of the work deals with the elements of public intervention and the conception of the mediation process and other concepts which are related to the main problem. Also it looks at the warrants of family courts which are established in Latvian laws. In the third part of the master work the author discusses and analyzes the actual problems which are observed in practice of family courts in Latvia and the problems family courts are osculating in their work, also the problematic aspects in jurisprudence of various instances of Latvian administrative and civil courts and legislation. In the conclusion, the author brings forward the result theses of the research.
The author concludes that the opinion that family institute is only full family with two or more generations in it is not acceptable, because one parent and child also constructs a family. There dominates the mistaken opinion in Latvia that there is no mechanism how to force parent to take into consideration the judgment of the court about parent right to communicate with the child – but the procedure how to make parent to consider the judgment is established in the law of Civil Process of Latvia.
