Sprieduma un citu institūciju un amatpersonu nolēmumu izpildes izdevumi

Abstract

Maģistra darba tēma ir „Sprieduma un citu institūciju un amatpersonu nolēmumu izpildes izdevumi”. Maģistra darba mērķis ir izanalizēt to sprieduma izpildes izdevumu regulējošo normatīvo aktu nepilnības, kuras tiesu izpildītāja ikdienas darbā rada diskusijas un neskaidrības to piemērošanā un dot priekšlikumus nepilnību novēršanai. Maģistra darba uzdevums ir, izmantojot analītisko, salīdzinošo un vēsturisko pētīšanas metodi un praksē gūto pieredzi, izpētīt tiesu izpildītāja procesuālās darbības, konstatēt problēmas sprieduma izpildes izdevumu ieturēšanā, atrast iespējamos risinājumus un dot priekšlikumus normatīvo aktu izstrādē. Lai sasniegtu darba mērķi un izpildītu uzdevumus, autore ir izpētījusi Maģistra darba tēmu regulējošos normatīvos aktus, kā arī salīdzinājusi tos ar ārvalstīs esošo tēmas regulējumu. Maģistra darba pirmajā daļā tiek analizēti tiesu un citu institūciju nolēmumi kā izpildu dokumenti un to atbilstība izpildu dokumenta jēdzienam. Otrajā daļā tiek dota nolēmumu izpildes izdevumu satura un maksāšanas pienākuma analīze. Šajā nodaļā ir izpētītas arī valsts nodevas, tiesu izpildītāju amata atlīdzības ieturēšanas problēmas kā arī problēmjautājumu analīze saistībā ar sprieduma izpildes izdevumu samaksu izbeidzot izpildu lietvedību. Maģistra darba trešajā daļā tiek sniegta analīze atsevišķu kategoriju izpildu lietām, konkrētāk, lietām, kurās piedziņa izdarāma valsts ienākumos, kā arī lietām par prasības nodrošinājuma izpildi. Maģistra darba izstrādes gaitā tika pētīta tiesu prakse, tēmu regulējošie normatīvie akti, publikācijas un pētījumi, kā arī izmantota autores praktiskā pieredze šajā sfērā. Maģistra darba pētījuma gaitā autore sniedz ierosinājumus sprieduma izpildes izdevumus regulējošo tiesību normu pilnveidei un grozījumiem.

The subject of the Master’s paper is “The Costs of the Enforcement of Judgment and Decision of other Institutions and Officials.” The goal of the Master’s paper is to provide an analysis of regulatory documents governing sentence execution costs resulting in discussions during regular work of a law enforcement officer, as well to analyze ambiguities in application procedure and to offer proposals for elimination thereof. The task set up in the Master’s paper is to investigate the legal proceedings of a law enforcement officer by means of analytic, comparative and historical research methods and by expertise, to discover problems in withdrawal process of sentence execution costs, to find possible solutions and to provide proposals for development of regulatory documents. In order to accomplish the goal and to complete the task the author has investigated regulatory documents governing subject of the Master’s paper and has compared them with relevant regulation applied in foreign countries. The first section of the master’s paper contains an analysis of resolutions made by courts and other authorities as executive documents and compliance thereof with a definition of an executive document. The second section provides an analysis of resolution execution costs and payment obligation. This section also contains a research of problems of levying state fees and office fees of law enforcement officers, as well an analysis of problems related to payment for resolution execution costs after termination of execution procedure. The third section of a master’s paper contains an analysis of several categories of execution cases, and particularly, the cases when the levying is made in favor of state, as well cases requiring execution of claim security. During the development of master's paper the author has investigated judicature, regulatory documents governing the selected subject, as well publications and researches, and implemented own expertise in the field. In the master’s paper, the author offers proposals for improving and amending legal norms regulating the resolution execution costs.
