Palestīnas atzīšana par valsti pēc valstiskuma kritērijiem

Abstract

Bakalaura darbā ir izpētīta aktuāla un praktiski nozīmīga starptautisko tiesību problēma, kas saistīta ar Palestīnas valsts atzīšanu. Pētījuma mērķis ir noskaidrot Palestīnas atbilstību valstiskuma kritērijiem, analizēt gan tradicionālos valstiskuma kritērijus, gan papildus, kā arī izpētīt, kādos gadījumos veidojumu var atzīt par valsti un vai Palestīna ir valsts. Visi darbā aprakstītie svarīgākie kritēriji analizēti tiesu prakses kontekstā. Darbs sastāv no divām nodaļām: pirmajā tiek analizēti valstiskuma kritēriju teorētiski aspekti, savukārt otrajā tiek izvērtēta Palestīnas atbilstība pirmajā daļā izpētītajiem kritērijiem, analizējot šī reģiona vēsturi, pievēršot uzmanību Apvienoto Nāciju Organizācijas pieņemtajām rezolūcijām attiecībā uz situāciju Tuvajos Austrumos, ieskaitot Palestīnas jautājumu.

The thesis researches actual and practically important problem in international law - the one related to recognition of the Palestine as a state. Aim of the research is to define if Palestine fulfills the statehood criteria, analyse both traditional statehood criteria, and additional ones, as well as explore cases, in which an entity can be recognised as a state, and if Palestine is a state. All main criteria described in the thesis are analysed in the context of judicial practice. The thesis consists of two main parts: in the first part the theoretical aspects of the statehood criteria are analysed, while second evaluates conformity of the Palestine to the requirements for statehood, analysing history of the region, and taking into account United Nations resolutions regarding the situation in the Middle East, including the Palestinian question.
