Ieturējumi no darba algas

Abstract

Darba tiesiskajās un civilprocesuālajās attiecībās aktuāla problēma ir ieturējumu veikšana no darbinieku darba algas, gadījumā, kad to dara darba devējs pēc savas iniciatīvas vai ar zvērinātu tiesu izpildītāju rīkojumu. Neviennozīmīgs ir jautājums par veicamo ieturējumu apjomu un saglabājamo darba algas apmēru pēc ieturējumu veikšanas. Bakalaura darba mērķis ir analizēt, secināt un veikt padziļinātu pētījumu par šobrīd Latvijā aktuālajām problēmām darba tiesiskajās attiecībās, kas saistītas ar ieturējumu veikšanu no darbinieka darba algas. Bakalaura darba uzdevums: pierādīt, ka pastāv pretrunas starp Darba likuma normām un Civilprocesa likuma normām veicot ieturējumus no darbinieka darba algas, sniegt savus risinājumus problēmas iespējamajai atrisināšanai. In the labour legal relations and civil procedure, an urgent problem is the retention of the performance of salaries of the employees in case the employer does it on his own initiative or at the bailiff’s order. Ambiguous is the issue of the retention amount to be taken and the retained amount of salary after deductions are made. The purpose of the Bachelors work is to analyse and deduce in a study of the current problems at the Latvian labour relations related to the withholding of a deduction from the employee's wages. The task of the Bachelor's work: to prove that there is a conflict between the norms of the Labour Law and the Civil Procedure Law making deductions from the employee's wages.
