Darbā aplūkoti patentu tiesību aizsardzības un patentu tiesvedības jautājumi.
Pirmajā darbā daļā aplūkots ar patentu tiesību saistītos pamatjautājumi – tādi kā definīcija, vēsture un patentu nošķiršana no citām tiesību nozarēm. Negaidīti, bet arī pamatjautājumu izpēte atklāja interesantus problēmu jautājumus, kas aplūkoti pētījumā. Patentu ekonomiskā vērtība ir ļoti augsta un vienmēr augošā, tādēļ tie bieži vien ir strīdus un tiesvedības objekts.
Pētījuma otrajā un trešajā daļā aplūkoti patentu spēkā esamības un ar patentu pārkāpumiem saistītie jautājumi. Patentu tiešie un netiešie pārkāpumi ir aplūkoti atsevišķi, jo tiem ir vairākas atšķirīgas iezīmes.
Darba nobeigumā uzmanība pievērsta patentu strīdu alternatīvām risināšanas metodēm un izgudrojumiem, kas rodas darba tiesiskajās attiecībās. The study explores patent rights and patent litigation matters in Latvia and issues related to them.
The first part of the study is devoted to basic questions concerning patents, such as definition, history and separation of patents from other kinds of law. Unexpectedly even the basics revealed interesting issues, which are explored in the study. The commercial value of patents is high and ever growing, therefore, the rights granted by the state when issuing a patent are highly valued and an object of endless disputes.
The second and third parts of the study deal with patent validity and patent infringements. Direct and indirect patent infringements are analyzed separately as they have different characteristics. Lastly alternative patent dispute resolution methods are explored and inventions created during employment relations are analyzed.
