Bakalaura darba galvenā tēma ir ievešana nekustamā īpašuma valdījumā. Darba mērķis ir izprast ievešanu nekustamā īpašuma valdījumā kā būtisku izpildu darbību, kura radīta, lai pilnvērtīgi aizsargātu procesā iesaistīto personu tiesības un ar likumu aizsargātās intereses.
Lai pilnīgāk izpētītu šo izpildu darbību, tiek aplūkota tā vieta starp nolēmuma izpildes veidiem, ievešanas nekustamā īpašuma valdījumā saturs, elementi un procesuālie aspekti, analizēta ārvalstu pieredze šajā jautājumā, kā arī tuvāk pētīta viena no aktuālākajām problēmām—īres līgumu pastāvēšana uz nekustamo īpašumu, kurā veicama ievešana nekustamā īpašuma valdījumā.
Darba rezultātā tiek piedāvāti vairāki iespējamie grozījumi Civilprocesa likumā, kā arī likumā Par dzīvojamo telpu īri, piedāvājot obligātu patstāvīgu īres līgumu reģistrāciju, lai efektivizētu ievešanas nekustamā īpašuma valdījumā procesu, kā arī padarītu vienlīdzīgākas iesaistīto personu tiesības un pienākumus. The main topic of this Bachelor’s work is placing in possession of real estate. The aim is to explore placing in possession of real estate as an important form of enforcement of judgments which is created to fully protect the rights and interests protected by law of individuals who are involved in this procedure.
In order to entirely ascertain this form of enforcement of judgments, the contents, elements and procedural aspects has been explored. Foreign experience and regulation has been analyzed as well. The main focus has been devoted to problems regarding with lease on the certain real estate, because this is one of the most important and pressing problems in placing in possession of real estate.
As a result of this work, author suggests several amendments to the Civil Procedure Law, and the law On Residential Tenancy, offering mandatory registration of permanent lease contracts in order to increase the effectiveness of procedure.
