Bakalaura darba tēma ir „Nozieguma mēģinājums”. Kaut nozieguma mēģinājums ir viens no nepabeigta noziedzīga nodarījuma veidiem, tas ir pietiekami bīstams. Vainīgā persona ar savam darbībām var nodarīt ar Krimināllikumu aizsargātajam objektam būtisku kaitējumu. Praksē joprojām pastāv problēmas nozieguma mēģinājuma kvalifikācijā, proti, nošķirt pabeigto noziedzīgo nodarījumu, sagatavošanos noziegumam, labprātīgas atteikšanas institūtu no nozieguma mēģinājuma.
Bakalaura darba mērķis ir aplūkot nozieguma mēģinājuma institūta attīstību Latvijas Republikā, izpētot normatīvos aktus, kas bija spēkā Latvijas teritorijā dažādos laika posmos. Darbā tiks aplūkotas nozieguma mēģinājuma kvalifikācijas problēmas, analizējot Latvijas Republikas tiesu praksi. Kā arī tiks salīdzināts nozieguma mēģinājuma institūta regulējums Latvijas Republikā ar Igaunijas, Krievijas Federācijas, Vācijas un Anglijas, ietverto nozieguma mēģinājuma institūta regulējumu. The topic of the present bachelor thesis is “Attempted crime”. While an attempted crime is a form of an incomplete criminal offence, it is nevertheless dangerous. An offender may cause a significant damaged to the object protected under Criminal law via one’s actions. In practice there are still a number of issues with the classification of an attempted crime i.e. a division between complete criminal offences, preparation of the crime, and institute of a deliberate refusal from the attempt of the crime.
The objective of the bachelor thesis was to review the development of the institute of an attempted crime in the Republic of Latvia by studying normative acts that were in force within the territory in Latvia during various periods. The paper reviews qualification problems relating to attempted crime by analysing the judicial practice of the Republic of Latvia.
