Prasījumu cedējamība

Abstract

Mūsdienu Latvijas civiltiesiskajā apgrozībā prasījumu cesijas institūtam ir liela nozīme, ko pierāda arī cesijas līgumu slēgšanas pieaugošā izplatība. Latvijas normatīvajos aktos prasījumi, kas var būt par cesijas priekšmetu, nav konkrēti uzskaitīti, kā rezultātā jautājums vai konkrētais prasījums var būt par cesijas priekšmetu, ir atstāts tiesu interpretācijas ziņā. Līdz ar to sašaurināti interpretējot Civillikuma normas, kas regulē cesijas priekšmetu un izņēmumus no tā, var tikt neattaisnots prasījumu cedējamības ierobežojumu mērķis un lieki kavēta privāttiesiskā apgrozība. Bakalaura darba mērķis ir izpētīt cesijas priekšmeta nozīmi, slēdzot cesijas līgumu, analizēt prasījumus, kuri nevar būt par cesijas priekšmetu, kā arī secināt, kādi izņēmumi ir pieļaujami no it kā necedējamiem prasījumiem, argumentējot, ka to raksturs atsevišķos gadījumos pieļauj prasījuma tiesību pāreju uz cesijas līguma pamata, vienlaicīgi nepārkāpjot likumā noteiktos ierobežojumus. Bakalaura darba uzdevums ir sasniegt bakalaura darba mērķi un apstiprināt bakalaura darba hipotēzi, izpētot prasījumu, kuri var būt par cesijas priekšmetu un kuri atzīstami par izņēmumiem no tā regulējumu Latvijas normatīvajos aktos un tiesu praksē. Iegūtie rezultāti: Autore bakalaura darbā konstatēja, ka Civillikuma regulējums attiecībā uz prasījumu cesiju var tikt interpretēts, pieļaujot prasījumu, kuros tikai formāli pastāv cesijas aizliegums, atzīšanu par necedējamiem. Ņemot vērā minēto, darba autore sniedza ieteikumus, kādi grozījumi būtu jāveic Civillikumā un kā atsevišķos gadījumos interpretēt cesijas ierobežojumus paredzošās tiesību normas, lai nevajadzīgi netiktu kavēta privāttiesiskā apgrozība. In modern Latvian civil law circulation the institute of assignment of claim is very important. It is proved with increasing number of cases when assignment of claim is concluded. In Latvian normative acts claims which may be the subject of the assignment, is not specifically listed as a result of the question whether the claim may be the subject of the assignment is left to judicial interpretation. The narrow interpretation of the Latvian Civil Law which regulates the possible objects of assignment and exceptions to it may not belie the aim of possibility to assign a claim and unnecessarily prevent private law return. The objective of this bachelor thesis is to analyse the meaning of the object of assignment. Explore claims which can’t be admitted as the object of assignment and come to conclusion which are exceptions of formally definite non-assignable claims showing that its temper in certain cases allows to change the ownership of claim. The aim of this bachelor thesis is to achieve the objective of this bachelor thesis and approve hypothesis exploring who of claims can be the object of assignment and which are considered to be exceptions to it from a side of regulation in Latvian normative acts and court practice. Acquired results: The author of this thesis established that Latvian Civil law regulation to assignment of claims may be translated in way which allows to consider assignable claims as non-assignable. The author of this thesis gives advices what changes to make in Latvian Civil Law and how in several cases interpret exceptions of assignment of claim so that unnecessarily would not be prevented private law return.
