Process par piespiedu ietekmēšanas līdzekļu piemērošanu juridiskajai personai

Abstract

Bakalaura darba mērķis ir izpētīt juridiskajām personām piemērojamo piespiedu ietekmēšanas līdzekļu tiesisko reglamentāciju, salīdzinot gan materiāltiesisko, gan procesuāltiesisko pirmsgrozījumu un pašreizējo regulējumu, tādējādi noskaidrojot procesa par piespiedu ietekmēšanas līdzekļu piemērošanu juridiskajai personai aktuālākos problēmjautājumus un sniedzot to iespējamu risinājumu. Lai sasniegta bakalaura darba mērķi, darbā ir izpētīta juridiskajām personām piemērojamo piespiedu ietekmēšanas līdzekļu institūta rašanās un attīstība Latvijas krimināltiesību sistēmā, apskatīta minētā institūta būtība no Krimināllikuma regulējuma viedokļa, apskatītas kriminālprocesuālā regulējuma izmaiņas laika gaitā, kā arī izpētīti teorijā vai praksē pastāvoši problēmjautājumi attiecībā uz minētā institūta piemērošanu. The aim of the bachelor thesis is to explore compulsory coercion measures applicable to legal person regulation, comparing material and procedural regulation before its amendments and after, thereby determining procedures of applying compulsory coercion measures to a legal person topical problems and suggesting possible solutions. To implement the aim of the bachelor thesis, there are procedures of applying compulsory coercion measures to a legal person institution emergence and evolution in Latvian Criminal system explored, cited institutions content from the point of view of the Criminal Law viewed, changes in the Criminal Procedure Law in the course of time viewed, and topical problems in the theory and practice regarding to applying cited institution explored.
