Paternitātes prezumpcijas piemērošanas problēmas

Latvijas Republikas Civillikuma ģimenes tiesību daļā ir ietvertas tiesību normas, kas regulē paternitātes noteikšanu. Atsevišķus jautājumus Civillikuma normas risina nepietiekoši vai neregulē vispār. Tādēļ pētījuma mērķis ir analizēt normatīvo regulējumu, kas attiecas uz bērna un tēva attiecību nodibināšanu, apskatīt galvenos priekšnosacījumus, kad mātes vīrs pamatojoties uz paternitātes prezumpciju tiek atzīst par bērna tēvu, kā arī iespējamās problēmas konkrētajā ģimenes tiesību jomā. Tā kā Latvija ir Eiropas Savienības dalībvalsts, tad tiek apskatīts paternitātes prezumpcijas regulējums dažādās Eiropas Savienības valstīs. Maģistra darbā ir akcentēti būtiskākie secinājumi, kas konstatēti pētījuma rezultātā, un iespējamie risinājumi ģimenes tiesību normatīvā regulējuma pilnveidošanai. Piemēram, priekšlikums paredzēt iespēju neierakstīt dzimšanas reģistrā mātes vīru kā bērna tēvu, pamatojoties uz mātes, mātes vīra (vai bijušā vīra) un vīrieša, kas sevi uzskata par bērna tēvu, kopīga iesnieguma pamata. Section of family law in The Civil Law of the Republic of Latvia includes regulation that governs filiation. Particular issues are not governed sufficiently or does not regulate in general. Therefore the aim of research is analysis of laws and regulations that affect establishment of child and father relationships, evaluating general principles, when the husband of the mother is presumed to be a father of a child according to the presumption of paternity and possible problems in this family law field. Since Latvia is member state of European Union it is also necessary to pay attention to presumption of paternity in different European Union countries. In this research report is reflected the most relevant conclusions and suggestions for improvement of family legislation, based on the findings and results of research. For example, proposition to provide a chance not to enter mother husband as the father in the birth registration of the child on the basis of a joint application of mother, mother’s husband (or ex-husband) and man who recognizes paternity of child.
