Pārrobežu laulību šķiršana pie Latvijas notāra: teorija, prakse un aktuālie problēmjautājumi Eiropas Savienībā

Abstract

Bakalaura darbs „Pārrobežu laulību šķiršana pie Latvijas notāra: teorija, prakse un aktuālie problēmjautājumi Eiropas Savienībā” sniedz ieskatu pārrobežu laulību šķiršanas tiesiskajā regulējumā no Latvijas notariāta skatupunkta. Darba mērķis ir izpētīt notariāta darbību un lomu pārrobežu laulību šķiršanas lietās, kā arī apskatīt problēmjautājumus, ar kuriem notāriem nākas saskarties piemērojot Eiropas Savienības starptautisko privāttiesību normas. Darba ietvaros autore veic izpēti un konstatē trūkumus un nepilnības nacionālajā tiesiskajā regulējumā, kā arī notāru darbībā, piedāvājot arī iespējamos risinājumus šo trūkumu novēršanai. Aizstāvēšanā iekļauto tēžu skaitā autore piedāvājusi konkrētas redakcijas grozījumiem Notaritāta likumā, definējusi pastāvīgās dzīvesvietas jēdzienu un izteikusi priekšlikumus saistībā ar jauna, laulāto atšķiršanas tiesību institūta ieviešanu Latvijas tiesību sistēmā.

Bachelor’s Thesis „Cross-border divorce cases settled by Latvian notary: theory, practice and current issues in European Union” provides an insight on the current issues of the cross-boarder divorce law judging from the viewpoint of a notary in Latvia. The aim of the research is to evaluate the practice and role of a notary in cross-border divorce cases, as well as to conclude issues met by notaries when applying the law of the European Union concerned with the international private law rules. The author researches and defines drawbacks and lacking regulation in the national law and in the practice of the notary institute, and suggests possible solutions. The author has developed the needed amendments for the Notariate law as part of the final thesis, as well as defined the habitual residence and developed proposals to introduce a new legal instrument of legal separation in the Latvian national law.
