Gribas trūkumi līgumtiesiskajās attiecībās

Abstract

Bakalaura darbā ir apskatīta viena no būtiskākajām līgumtiesību sastāvdaļām - gribas trūkumi. Darba mērķis ir apzināt LR Civillikuma gribas trūkumu regulējuma nepilnības un sniegt priekšlikumus nepilnību novēršanai. Tas tiek panākts, izanalizējot LR Civillikuma, Lietuvas un Igaunijas Civillikumu, kā arī Kopējā Modeļa (Draft Common Frame Of Reference) gribas trūkumu regulējumu un pēc tam salīdzinot tos. Darba izstrādāšanas rezultātā tiek sniegti priekšlikumi LR Civillikuma gribas trūkumu regulējuma nepilnību novēršanai un modernizēšanai. Darbā tiek izmantotas šādas zinātniski pētnieciskās metodes - analītiskā, sistēmiskā un salīdzinošā.

The Bachelor’s paper is about one of the most fundamental elements in contract law - vices of consent. The purpose of the paper is to identify problems in regulation of vices of consent in Civil Code of Latvia and to offer suggestions in order to improve it. That will be achieved by analyzing regulation of vices of consent in the Civil Code of Latvia, Lithuania and Estonia and the Draft Common Frame Of Reference and comparing them afterwards. The results of the paper are several suggestions for improving regulation of vices of consent in the Civil Code of Latvia thereby modernizing it. In the paper there are used following methods of scientific research - analytical, systemic and comparative.
