Ceļa zīmju juridiskais raksturojums.

Abstract

Ceļa zīmes administratīvajās tiesībās ir maz pētīts jautājums Latvijā. No vienas puses, tiesību literatūrā un judikatūrā ir nostiprināta atziņa, ka ceļa zīmes uzskatāmas par vispārīgu administratīvu aktu. No otras puses, minētā atziņa rosina domāt un vērtēt - vai šāda ceļa zīmju tiesiskā daba attiecas uz visām ceļa zīmēm; kā raksturojama ceļa zīmju paziņošana; ko darīt, ja ceļa zīme pārkāpj privātpersonas tiesības.

Bakalaura darbs „Ceļa zīmju juridiskais raksturojums” izskaidro un sniedz atbildi uz vairākiem problēmjautājumiem, tajā skaitā, bet ne tikai, iezīmējot loku, kura ietvaros ceļa zīmes atzīstamas par vispārīgo administratīvo aktu, izskaidrojot, kā juridiski regulēta ceļa zīmes paziņošana, turklāt darbā izmantojot Vācijas tiesību zinātnēs izklāstītās atziņas.

There have been a few investigations in Latvia regarding the issue of the road signs in connection with administrative law. On the one hand it has been concluded that the road signs are considered to be general administrative act. On the other hand this finding suggests to think whether this kind of legal nature should be attributed to all the road signs, how the notification of the road signs may be described, what to do if a traffic sign violates the rights of individuals. The Bachelor thesis „The legal description of the road signs” explains and provides an answer to a number of issues, identifying the scope within which the road signs shall be recognized being general administrative act, explaining how the notification of the administrative act is being regulated, meanwhile taking into consideration findings estabilished in German legal science.
