Kreditora, mantinieka un valsts interešu sadursme mantojuma lietā

Abstract

Arvien biežāk civiltiesiskajā apgrozībā ir gadījumi, kad pēc personas nāves mantinieki atsakās no mantojuma, jo tas apgrūtināts ar parādsaistībām, kas pārsniedz mantojuma vērtību. Tāpat mēdz būt gadījumi, kad mantojuma atstājējam nav palikuši mantinieki, līdz ar to rodas pamats mantojumu atzīt par bezmantinieku mantu. Šādos gadījumos, kad mantojuma masa iegūst bezmantinieku mantas statusu, tā piekrīt valstij. Pētijuma rezultātā autore secina, ka mantojuma tiesībās attiecībā uz „kreditora un mantinieka” un „kreditora un valsts” tiesiskajām attiecībām pastāv tiesiskā regulējuma nenoteiktība, tiek identificētas problēmas tiesiskajā regulējumā mantojuma tiesībās un izteikti priekšlikumi grozījumiem. Recently in the civil circulation there are more often cases, when after person’s death the inheritors refuse to accept the inheritance, because it is burdened with debts which value exceeds the value of inheritance. Also there are cases, when the deceased has no inheritors, so the inheritance is considered as the escheat. In such cases, the escheat is recognised as the property of the state. In the result of this study, the author concludes that in the inheritance law questions relating to „creditors and inheritors” and „creditors and sates” mutual legal relations exists problems of legal certainty, and identifies problems in the legal framework of inheritance law and proposes amendments.
