Neatraidāmo mantinieku institūta nepieciešamība

Bakalaura darbā „Neatraidāmo mantinieku institūta nepieciešamība” autore pēta Latvijas tiesību zinātnē pēdējos 20 gados maz pētītu jautājumu – vai neatraidāmo mantinieku institūts ir pamatots un vai tā regulējums atbilst Latvijas sabiedrības vajadzībām un tiesību zinātnes atziņām. Pētījuma ietvaros autore izpēta neatraidāmo mantinieku institūta izcelsmi romiešu tiesībās, kā arī tā laika pamatojuma vēsturisku attīstību līdz mūsdienām Rietumeiropas tiesību sistēmās un Latvijā. Autore konstatē, ka pamatojums, kas lietots minētā institūta ieviešanai, mūsdienās savu aktualitāti ir zaudējis, taču jauns pamatojums tiesību zinātnē ir veidots tikai fragmentāri un nerada pietiekamu pārliecību par minētā institūta nepieciešamību. Autore rosina pārskatīt neatraidāmo mantinieku institūtu, ievērojami sašaurinot testatora rīcības brīvības ierobežojumus. In the thesis „The need of the institution of undeclinable heir” a rarely researched subject in Latvian Law is researched – is the institution of undeclinable heir substantiated and fulfils the present regulation the needs of Latvian society and concepts of legal science. Author researches origins of this institution in Roman law, as well as historic development of the reasons of this institution till present day in systems of law in Western Europe and Latvia. Author finds that reasons, that were used to substantiate the introduction of the institution, have lost importance, but new reasons are formed only partially and do not create reasonable trust in the need of this institution. Author proposes to reform the institution of undeclinable heir, substantially giving up limitations to the free will of the testate.
