Zusammenfassung
Galvenais uzsvars darbā „Kriminālprocesuālā imunitāte” ir uz kriminālprocesuālo imunitāti, kas piešķirta deputātiem, jo tās apjoms šobrīd ir uzskatāms par ārkārtīgi plašu un līdz ar to rodas strīdīgs jautājums, vai tas ir samērīgs attiecībā pret vienlīdzības principu.
Tātad darba mērķis ir noskaidrot, vai tāds deputātu kriminālprocesuālās imunitātes regulējums, kādu šobrīd paredz Latvijas Republikas normatīvie akti, ir atbilstošs. Lai deputāta kriminālprocesuālā imunitāte būtu samērīga, tai ir jābūt attaisnojamai ar objektīvu pamatojumu, un nevis izmantotai, lai tautas priekšstāvji varētu slēpties aiz viņiem piešķirtās imunitātes.
Bakalaura darba rezultātā autore ir secinājusi, ka pašreizējais deputāta kriminālprocesuālās imunitātes apjoms tik tiešām ir nesamērīgs un to ir nepieciešams samazināt. The main focus in this work is on the criminal immunity granted to the members of the Parliament, because nowadays its amount is considered to be too extensive and therefore arises the controversial question of whether it is proportionate to the principle of equality.
So the objective of the work is to establish whether the criminal immunity of members of the Parliament is appropriate in the extent it is provided at this moment by the laws of the Republic of Latvia. Proportionate parliamentary immunity from criminal prosecution needs to be justifiable by objective reasons and not to be used in order for the members of the Parliament to hide behind the immunity granted to them.
In the result of this bachelor’s thesis, the author has concluded that the current extent of the immunity is indeed disproportionate and so must be reduced.
