Konstitūcijas preambula un tās nozīme

Abstract

Bakalaura darbs ir veltīts konstitūcijas preambulai. Līdz šim lielu vērību tā nebija izpelnījusies tiesību zinātnieku lokā, bet līdz ar Latvijas Republikas Satversmes papildināšanas projekta ierosināšanu, tēma izpelnījusies uzmanību ne vien pašu tiesību zinātnieku lokā, bet daudz plašākā sabiedrībā. Pētījuma mērķis ir noskaidrot, kāds ir konstitūcijas preambulas jēdziena skaidrojums, tās saturu, nozīmi un elementus. Konstitūcijas preambula kā viens no konstitūcijas elementiem ir interesants izpētes objekts, jo tam ir gan juridiska, gan morāla loma valstī. Preambula var būt kā avots tiesību normu piemērotājam, gan veicot interpretāciju, gan esot kā iedvesmas avots ikvienam valsts iedzīvotājam par savu valsti un tās nākotni, jo preambula atspoguļo ne tikai tās pagātni, bet arī virzību uz nākotni.

This work is devoted to the preamble of the Constitution. Until now it has not attracted the attention of scientists, but within the project of improvements in the Constitution of Republic of Latvia, this theme has attracted the attention not among scientists, but also much broader society. The aim of this work is to clarify the concept explanation of the Constitution preamble, its content, meaning and elements. The preamble of the Constitution as one of the elements of the Constitution is an interesting subject of research, because it has both – sided roles in the state - legal and moral. The preamble may be as the source of the adopter, while making an interpretation, and also as a source of inspiration to every citizen of the state about their country and its future, because the preamble of the Constitution reflects not only to the past, but also towards the future of the country.
