Abstract

Bakalaura darba tēma ir „Īpašuma aprobežojumu civiltiesiskie aspekti”. Īpašuma aprobežojumu noteikšana un to nozīme ir aktuāls jautājums mūsdienu sabiedrībai. Darba mērķis ir aptvert un izpētīt īpašuma lietošanas aprobežojumu, servitūtu un reālnastu tiesisko regulāciju. Apzināt ar aprobežojumu nostiprināšanu zemesgrāmatā saistītās problēmas un rast juridisku risinājumu. Darba uzdevumi ir izanalizēt juridisko literatūru un tiesas spriedumos paustās tiesas atziņas. Aplūkot zemesgrāmatās ietvertos aprobežojumu veidus. Darbs sastāv no četrām nodaļām, sešām apakšnodaļām. Pirmajā nodaļā izklāstīts īpašuma lietošanas aprobežojumu jēdziens un nepieciešamība. Otrajā nodaļā uzskaitīti aprobežojumu noteikšanas tiesiskie pamati. Trešā nodaļa veltīta Latvijas Civillikumā ietverto īpašuma aprobežojumu raksturojumam. Bachelor's thesis: „Civil law aspects of property restriction”. Property restriction identification importance is an issue in today's society. Thesis aim is to: cover and investigate the restriction of use of the property, easements and real encumbrance legal regulation. To study the restriction of the land registry related problems and find legal solutions. Thesis task is to analyze the legal literature and court judgments expressed finding by the Court. Analyze restriction types of Land Registers. The first chapter contains concepts and necessity of the property restrictions. The second chapter lists the legal foundations upon determination restrictions. The third chapter is devoted to characteristics of property restrictions contained in Latvian Civil. The fourth and final chapter contains author’s practical application part about recordings on Land Register of the property restrictions.
