Darba rakstīšanas rezultātā tika izpētīts jēdziens „morālais kaitējums”, analizēts cietušais kriminālprocesā un apskatīti morālā kaitējuma kompensācijas pieteikumi un tiesas spriedumi, lai saprastu tiesas vadmotīvus, nosakot kaitējuma kompensācijas apmērus. Darba mērķis ir izprast jēdzienu „morālais kaitējums” un saprast tiesas kritērijus kaitējuma kompensācijas apmēra noteikšanā.
Izvirzītā mērķa sasniegšanai darbā noteikti šādi uzdevumi – noteikt personu loku, kuriem ir tiesības uz morālā kaitējuma atlīdzināšanu kriminālprocesa ietvaros, analizēt cietušā lomu kriminālprocesa uzsākšanai un izprast kritērijus morālā kaitējuma kompensācijas aprēķināšanai.
Darbā iegūtie rezultāti liecina, ka Latvijas Republikā nav vienota tiesu prakse par morālā kaitējuma kompensāciju un nav izstrādāti saprotami kritēriji kaitējuma kompensācijas aprēķināšanai.

The concept of moral damage is examinated, the victim in criminal procedure is analyzed and deals with applications for the remuneration of moral damage were disccused for understanding the motives of judgment. The objective is to examine the concept of „moral hazard” and the criteria for the determination of the amount of remuneration for the moral damage.
To achieve the goal the following tasks were set: to determine the group of persons who are entitled to moral damages in criminal proceedings, to analyze the victim's role in the initiation of criminal proceedings and to define the criteria for the calculation of compensation of moral hazard.
The results obtained show that the Latvian Republic hasn’t got a common jurispudence for moral damage compensation and the criteria for the calculation of the amount of remuneration for the moral damage.
