The assessment of creditworthiness enables the prevention of potential losses, if a borrower fails to comply with the undertaken liabilities, and safeguards the borrower against undertaking excessive liabilities.
The purpose of the present paper and the arising tasks is to clarify the following issues: whether the assessment of creditworthiness is a creditor's obligation or a creditor's rights, what consequences arise from a failure to assess creditworthiness and the responsibility thereof, what opportunities to assess a person's creditworthiness are actually available and whether the planned commencement of the operation of Credit Information Bureaus solves the current problems regarding the assessment of creditworthiness.
Although an obligation to assess a consumer's creditworthiness has been stipulated by the legislation, in practice, however, individual non-compliance with the requirements and limited opportunities to assess a person's creditworthiness have been identified.
Keywords: creditworthiness, loan (past due), insolvency, Credit Register, loan database, responsible lending and responsible borrowing.
