Laulības šķiršanas tiesiskie aspekti starptautiskajās privāttiesībās Eiropas Savienībā

Pieaugošā personu pārvietošanās ES ietvaros ir veicinājusi „starptautisku” laulību noslēgšanu skaita pieaugumu laulātajiem ar dažādu valstu pilsonību vai arī, ja laulātie dzīvo dažādās dalībvalstīs, vai arī dzīvo dalībvalstī, kas nav viņu pilsonības valsts. Tādā gadījumā, ja „starptautisks” pāris vēlas šķirties, ir būtiski noskaidrot konkrētās valsts laulību izpratni, lai nodrošinātu, ka laulība tiks uzskatīta par spēkā esošu un līdz ar to arī šķiramu. Ja iepriekš minētais izpildās, ir jānosaka laulības šķiršanas jurisdikcija un piemērojamais likums.
Saskaņā ar pašreizējo regulējumu, piemērojamais likums tiek noteikts ar nacionālo kolīziju tiesību normu palīdzību, kur tiek piemēroti dažādi piesaistes kritēriji. Līdz ar to nacionālo kolīziju tiesību normu atšķirības izraisa noteiktas problēmas starptautisko privāttiesību jomā. Taču pirms piemērojamā likuma noteikšanas, ir jānosaka kompetentās tiesas jurisdikcija skatīt laulības šķiršanas lietu.
Lai novērstu pašreizējās nacionālo kolīziju tiesību normu atšķirības, Eiropas Komisija nesen ir piedāvājusi veikt grozījumus regulā Nr.2201/2003 par jurisdikciju un spriedumu atzīšanu un izpildi laulības lietās un lietās par vecāku atbildību un par Regulas (EK) Nr. 1347/2000 atcelšanu. The increasing mobility of citizens within the European Union has resulted an increasing number of “international” marriages where the spouses are of different nationalities or live in different Member States, or live in a Member State of which they are not nationals. In the event that an “international” couple decide to divorce, it’s important to clarify the perception of the marriage in the certain member state to ensure that the marriage will be regarded as valid and hence diccolube. In the case the aforesaid is accomplished, the jurisdition and the applicable law to the divorce procedure has to be determined.
According to the present regulation the applicable law to divorce is established by the national conflict of law rules, where different connecting factors are used. Hence the divercity of national conflict of laws cause certain problems in international private law area. But before determing the applicable law by the certain country conflict of law rules, the jurisdiction of the competent court has to be established.
To put down the the distictions of national conflict of law regulation lately the Europian Commision has proposed to amend the Regulation Nr.2201/2003 as regards jurisdiction and introducing rules concerning applicable law in matrimonal matters.
