Maģistra darbā „Krāpšana nodokļu un nodevu iekasēšanas jomā”, autors noskaidro krāpšanas nodokļu un nodevu iekasēšanas jomā jēdzienu, raksturo šāda nodarījuma pazīmes, analizē ar šādu nodarījumu kvalifikāciju saistītās problēmas un pēta citu valstu pieredzi cīņā ar šādiem noziedzīgiem nodarījumiem.
Darbs sastāv no četrām nodaļām, kas sadalītas divdesmit vienā apakšnodaļā. Tā pirmajā nodaļā ir noskaidrots krāpšanas nodokļu un nodevu iekasēšanas jomā jēdziens un raksturīgākās izpausmes.
Otrajā nodaļā ir sniegts šāda nodarījuma sastāva pazīmju raksturojums.
Trešajā nodaļā ir analizēta krāpšanas nodokļu un nodevu iekasēšanas jomā saistība ar citiem noziedzīgiem nodarījumiem, galvenokārt analizējot to saistībā ar pievienotās vērtības nodokļa pārmaksas atmaksas izkrāpšanu.
Ceturtajā nodaļā pētīts krāpšanas nodokļu un nodevu iekasēšanas jomā regulējums starptautiskajos tiesību aktos, pievienotā vērtības nodokļa ieviešana Eiropas Savienībā un ar to saistītā problemātika, kā arī citu valstu pieredze šādu noziedzīgu nodarījumu apkarošanā.
Analizējot Latvijas un citu pasaules valstu pieredzi krāpšanas nodokļu un nodevu iekasēšanas jomā izskaušanā, autors izdarījis secinājumus, kas saistīti ar šāda nodarījuma kvalifikācijas problēmu risināšanu un piedāvā Krimināllikumā iekļaut jaunu pantu, kurā īpaši būtu paredzēta atbildība par šāda veida noziegumiem.
Maģistra darbs sastāv no ievada, četrām nodaļām un kopsavilkuma. In masters work "Fraud in the tax and fee collection field”, the author clarifies fraud in the field of tax and fee collection concept, describes such an offense, characteristics are analyzed with the following offense classification problems and explore other experiences in combating such crimes. Work consists of introduction, four chapters, subdivided in twenty-one subdivision.
Introduction is composed of the topicality of the given theme, purposes of the work and used methods.Its first chapter clears up frauds in the tax and fee collection field concept and typical disclosures. The second chapter gives characterization of fraud in field of tax and fee collection. The third chapter analysis how such crime links to other criminal offenses, primarily by analyzing the context of value-added tax refund overpayment scams. The fourth chapter researches tax frauds regulation in international law, the introduction of value added tax in the European Union and the associated problems, as well as the experience of other countries in combating such crime. In analysis of Latvian and other world experiences in fight against fraud in field of tax and fee collection, the author committed the findings which are related with qualifying such an offense and offers to include a new article in Latvia’s Criminal Law which would be particulary liability for such crimes. Master's thesis consists of an introduction, four chapters and a summary.
