Ar brīvības atņemšanu notiesāto personu veselības aprūpe nacionālo un starptautisko tiesību normu skatījumā

Tiesības uz pienācīgu veselības aprūpi pieder ikvienam, arī ieslodzītajām personām, ko reglamentē kā starptautiskie, tā arī nacionālie tiesību akti. Tādēļ dotais maģistra darbs pēta ar brīvības atņemšanas sodu notiesāto personu veselības aprūpes starptautisko un nacionālo tiesisko regulējumu, nostādot to kā maģistra darba mērķi. Maģistra darba mērķa sasniegšanai tika analizēti Apvienoto Nāciju Organizācijas starptautiskie līgumi, Eiropas Savienības līmeņa rekomendācijas un noteikumi, kā arī nacionālais – Latvijas Republikas– tiesiskais regulējums un prakse ieslodzīto veselības aprūpes jomā.
Pētījuma rezultātā nacionālajā likumdošanā tika konstatētas neatbilstības starptautiskajam regulējumam. Neatbilstības skar dzīves apstākļus ieslodzījuma vietās, kas tieši ietekmē ieslodzīto personu veselības stāvokli. Tāpat maģistra darbā tika izskatītas ieslodzīto veselības aprūpes uzlabošanas iespējas. Prisoners, as every person have a right to due health care; this is governed by both the international and national law. In the present Master's Paper, therefore, studying of the international and national legal framework governing health care of persons convicted with imprisonment has been defined as the task of the Paper. For the attainment of the aim of the Master's Paper, international agreements of the United Nations Organisation, European Union level recommendations and regulations, as well as national legal framework of the Republic of Latvia and the practice in the field of health care of prisoners were analysed.
As a result of the study, incompliances of the national laws with the international framework were identified. These incompliances concern living conditions at the imprisonment places, which have a direct influence on health condition of prisoners. Another subject examined in the framework of the Master’s Paper was the possibility to improve health care of prisoners.
