Saskaņā ar Tieslietu ministrijas datiem valstī kopumā ir vairāk nekā 17 000 dalītu īpašumu, kas ir pretrunā Civillikumā ietvertajam zemes un ēkas vienotības principam. Dalīta īpašuma rezultātā praktiski tikai vienas no īpašuma tiesībām ir reāli izmantojamas, turpretim otras šajā gadījumā cieš no aprobežojuma un reāli nav izlietojamas.
Ņemot vērā minēto, maģistra darba „Dalīta nekustamā īpašuma problemātika Latvijā” mērķis ir iztirzāt dalītu īpašumu vēsturisko rašanos, izpētīt dalītu īpašumu izbeigšanās iemeslus Latvijas Republikā 20.gadsimta 30.gados un tā reģenerāciju pēc atjaunotā Latvijas Republikas 1938.gada Civillikuma stāšanās spēkā.
Tāpat maģistra darba mērķis ir apzināt ar zemes piespiedu nomu saistītos problēmjautājumus un sniegt priekšlikumus tiesiskā regulējuma pilnveidei.
Visbeidzot, maģistra darba mērķis ir sniegt priekšlikumus dalīta īpašuma turpmākai izbeigšanai Latvijas tiesībās, atjaunojot zemes un ēkas nedalāmības principu.
Maģistra darba noslēgumā apkopoti autores secinājumi un priekšlikumi, kas varētu sekmēt taisnīgāku līdzsvaru starp zemes un ēku (būvju) īpašnieku tiesiskajām interesēm, kā arī priekšlikumi, kas varētu kalpot par pamatu dalītu īpašumu likvidācijai Latvijas tiesībās. According to the data of the Ministry of Justice, there are in total more than 17 000 divided properties in the country, which contradicts the principle of the unity of land and building contained in the Civil Law. The divided property virtually results in only one of the property rights being actually usable, whereas the other suffers restrictions and cannot be actually exercised in this case.
Considering the above, the objective of the Master thesis „Problems of the divided property in Latvia” is to review the historical development of the divided properties, to study the reasons for termination of divided properties within the Republic of Latvia during the 30’ties of the 20th century and the regeneration thereof after the restored 1938 Civil Law of the Republic of Latvia came into force.
The objective of the Master thesis is also to explore the issues related to the compulsory land rent and to provide proposals for improvement of the legal regulations.
At last the objective of the Master thesis is to provide proposals for future termination of the divided property within the law of Latvia, thus restoring the principle of the unity of land and building.
The closure of the Master thesis contains conclusions and proposals made by the author, which might encourage a more equitable balance between the legal interests of the land and building (structure) owners, as well as proposals, which might serve as grounds for termination of divided property within the law of Latvia.
