Īpašuma uz nekustamām lietām iegūšana uz darījuma pamata

Abstract

Darbā ir apskatīti aktuālie problēmjautājumi, kas ir saistīti ar nekustamu lietu īpašuma iegūšanu uz darījuma pamata. Darbā ir izpētītas spēkā esošā tiesiskā regulējuma nepilnības un tiesu prakse attiecīgo jautājumu risināšanā. Autors darba izstrādes rezultātā ir nācis klajā ar vairums ieteikumiem grozīt normatīvo regulējumu, lai mēģinātu novērst darbā norādītos problēmjautājumus, piemēram, tādu jēdzienu kā „tiesiskais pamats” vai „nodošana” neprecīzu lietojumu, neskaidrības ar likuma regulējumu, t.sk. īpašuma labticīga ieguvēja regulējumu likumā, u.c. jautājumiem, kas arī bija šī darba pamatmērķis. Papildus ieteikumiem par grozījumiem likumā, autors ir izvirzījis arī jaunas un vērtīgas teorētiskas tēzes. Ar ieteikumiem un tēzēm var iepazīties darba iztirzājumā un kopsavilkumā.

Urgent issues related to the acquisition of the immovable things by the legal transaction have been reviewed in this work. Author studied the gaps in the effectual legal regulation and case law on resolving respective issues. As the result of writing this work author has appeared with the number of suggestions for the amendments of the legal regulation to attempt the elimination of the issues mentioned in the work, for example, inaccurate use of such legal concepts as “legal ground” or “transference”, uncertainty with the legal regulation, inter alia regulation of property acquirer who is acting in good faith, a.o. issues, which was the main objective of this work. In addition to the suggestion for the amendments to the law author also has came out with new and valuable theoretical thesis.
