Abstract

Maģistra darba „Kriminālatbildība neatļautai priekšmetu nodošanai personām un saņemšanai no personām, kas ievietotas īslaicīgās aizturēšanas un brīvības atņemšanas vietās” ietvaros, izvirzīts mērķis īstenot šā nodarījuma satura analīzi. Darba izstrādes gaitā autore identificē prettiesiskās darbības kā sodāma nodarījuma tiesiskos pamatus un izcelsmes norisi, kā arī ārvalstu regulējuma nostādnes, līdztekus formējot atbilstoša raksturojuma esamību un izpratnes aspektus. Nodarījuma sastāva pazīmju apzināšanas posmā, kas modelē krimināli sodāma nodarījuma iestrādes, izvērtēta attiecīgās rīcības konstrukcija. Sekmīgai neatļautās darbības izpētei, maģistra darba struktūru veido ievads, četras nodaļas un trīs apakšnodaļas, kā arī kopsavilkums, kurā sniegti autores secinājumi un zināmi ieteikumi, definējot noteiktu nodarījuma elementu kopuma pamatu.

The aim in the framework of the master‘s thesis „The criminal liability of illicit transfer and reception of objects to persons and from persons who are placed in short term detention and in penitentiary institutions” is to implement analysis of the content of this offence. Throughout the thesis, the author identifies the legal nature of the unlawful action which constructs a course of origin of this offence as well as approach of foreign regulation alongside with formation of existence of appropriate disposition and aspects of perception. The construction of respective behaviour simulates elaborations of an offence punishable with criminal penalties. Thesis consists of an introduction, four chapters and three subchapters, and a summary where author’s conclusions and certain suggestions are provided by defining a basis of the set of specific elements of the offence.
