Krāpšanas kvalifikācijas problēmas

Abstract

Maģistra darbā tiek pētīta krāpšanas jēdziena būtība, apzinātas krāpšanas izpausmes formas un kvalifikācijas problēmas pašreizējā tiesu praksē. Darbā ir sniegts ieskats krāpšanas attīstības vēsturē, definēts šī noziedzīgā nodarījuma jēdziens un veikta juridiskā analīze. Maģistra darbā ir veikta pēdējo gadu tiesu prakses spriedumu analīze lietās par krāpšanu un konstatētas kvalifikācijas problēmas. Maģistra darba izstrādes gaitā ir pievērsta uzmanība jau esošām teorētiskām un praktiskām atziņām par krāpšanu, kas vēl aizvien netiek ievērotas tiesu praksē. Maģistra darba rezultātā ir piedāvātas atziņas, kas varētu novērst krāpšanas kvalifikācijas kļūdu atkārtošanos tiesu praksē. Maģistra darba apjoms ir 80 lapas un tā sekmīgai izstrādāšanai tika izmantoti 70 informācijas avoti. Atslēgvārdi: Krāpšana, viltus, maldība, ļaunprātīga uzticības izmantošana.

In Master paper has been analyzed the concept of fraud, considered fraud forms of expression and problems of qualification in the current jurisprudence. In this work is given the short review of the history of fraud, defined the concept of the offense and is analyzed the legal structure of it. In the Master paper have been discussed the recent years judgments in cases of jurisprudence about fraud and there is stated some detection and qualification problems in fraudulence process. During the investigation the author focused to the existing theoretical and practical knowledge of the fraud, which are discussed before, but is still not complied in jurisprudence. Finally are offered insights that could prevent the recurrence of qualification mistakes in jurisprudence of fraud. The Master paper consists of 80 pages and for the successful development were used 70 different literature sources. Keywords: Fraud, deception, abuse of confidence.
