Vardarbīgu nodarījumu pret nepilngadīgajiem kvalifikācijas teorētiskie un praktiskie aspekti

Abstract

Maģistra darba tēma ir „Vardarbīgu nodarījumu pret nepilngadīgajiem kvalifikācijas teorētiskie un praktiskie aspekti”. Latvijā cietsirdība un vardarbība pret nepilngadīgo ir aktuāla problēma, jo vēl daudzi cilvēki bērnu sodīšanu gan ar emocionāliem, gan fiziskiem paņēmieniem uzskata par pieņemamu praksi bērna audzināšanā, lai gan bērna sodīšana ar šādiem paņēmieniem ir krimināli sodāma. Latvijā kriminālsodāmi ir daudzi vardarbīgi noziedzīgi nodarījumi pret nepilngadīgajiem. Taču darba autors ir izvēlējies darbā detalizētāk izanalizēt Krimināllikuma 174. pantā paredzēto noziedzīgā nodarījuma teorētiskos un praktiskos aspektus. Aprakstīt, kā šo noziedzīgo nodarījumu nošķirt no citiem noziedzīgiem nodarījumiem, izpētīt, kas ir cietsirdība un vardarbība – seksuāla, emocionāla, fiziska, kā arī novārtā pamešana, kā tās nošķirt vienu no otras un kā tās izpaužas praksē. The theme of Masters is about „Violent offenses against minors qualifications theoretical and practical aspects”. In Latvian cruelty and violence against minors is an urgent problem, because there are a lot of people penalizing children with both emotional and physical methods and considering it acceptable practice in his upbringing, even though the child's punishment with such techniques is a criminal offense. In Latvia there are many criminal violent crimes against minors. However, the author has chosen more detailed analysis of the Criminal 174th Articles offense theoretical and practical aspects. Describe how this offense will be distinguished from other offenses, explore what is cruelty and violence - sexual, emotional, physical, and neglect abandonment, how to separate each other and how they are manifested in practice. In the Master the author tries to give a solution, how to adjust and solve in the master's work problems identified in relation to the cruel and violent offense
