Maģistra darba mērķis ir izpētīt likuma „Par preču zīmēm un ģeogrāfiskās izcelsmes norādēm” tiesību normu, kas paredz noteikumus par preču zīmju nelikumīgu izmantošanu, piemērošanas problēmas, un sniegt šo normu Eiropas Savienības un starptautiskajiem tiesību aktiem atbilstošu interpretāciju. Darbā tiek noteikts preču zīmes īpašnieka izņēmuma tiesību apjoms, apzināti un analizēti priekšnoteikumi, lai darbību varētu kvalificēt kā preču zīmes nelikumīgu izmantošanu, kā arī noteikti gadījumi, kuri ierobežo preču zīmes īpašnieka izņēmuma tiesības. Autors secina, ka likuma interpretācijas grūtību dēļ Latvijas tiesas pieļauj kļūdas attiecīgo tiesību normu piemērošanā. Piemēram, tiesas analizē tikai dažus no obligātajiem zīmju salīdzināšanas kritērijiem un neizvērtē apstākļus, kuros attiecīgais patērētājs nonāk saskarsmē ar salīdzināmajām zīmēm. The aim of the master’s thesis is to study the issues in application of the statutory law, which establishes the provisions on trade mark infringement, stipulated in the Law on Trademarks and Geographical Indications, and to provide such interpretation for the statutory law, which would correspond to the legislative acts of the European Union and international legislative acts.
Thesis defines the scope of the exclusive rights of a trade mark owner, analyses prerequisites necessary for an act to qualify as a trade mark infringement, as well as defines situations in which the exclusive rights of the trade mark owner are limited.
Author concludes that due to the difficulties in interpretation of law, Latvian courts are making mistakes while applying the relevant provisions. For instance, courts analyze only some of the mandatory criterions in comparing the signs and do not evaluate conditions in which the relevant consumer interferes with the comparable signs.
