Abstract

Maģistra darba „Preču zīmes” mērķis ir konstatēt preču zīmju sistēmā galvenās nepilnības un izstrādāt priekšlikumus sistēmas uzlabošanai. Autore pēta galvenos problemātiskos aspektus preču zīmes regulējumā tās regulējošajos normatīvajos aktos, lai pēc iespējas vairāk uzlabotu reģistrācijas procesa kvalitāti un preču zīmes īpašnieka garantijas reģistrācijas iegūšanas rezultātā. Šajā darbā autore piedāvā uzlabojumus esošajā sistēmā, piemēram, piedāvā grozīt preču zīmes reģistrācijas ilguma termiņu, ieviest vispasaules preču zīmju reģistru, grozīt pašlaik esošo formālo ekspertīzes procedūru, ieviešot tās reālu nepieciešamību, ieviest preču zīmes meklējumu kā obligātu procesa sastāvdaļu, kā arī izstrādāt vadlīnijas preču zīmes atšķirīguma novērtējumam.

The aim of the Master’s work “Trade marks” is to find out the main disadvantages in the system of Trademarks and to make the proposals for system improvement. The Author studies the main problematic aspects in the trade mark laws and regulations so that to improve as much as possible the registration process quality and the Trade mark owner’s guaranties in the registration obtaining result. In this work the Author propose improvements in the existing system, for example, propose to change the Trade mark registration duration term, to introduce the worldwide Trade mark registration, to change the existing formal expertise procedure by introducing it’s real necessity, to introduce Trade mark searching as obliged part of the process, as well as to work out the guidelines for the Trade mark differences estimation.
