Bankas klienta noslēpuma tiesiskie aspekti

Abstract

Kredītiestāžu likumā noteiktais bankas klienta noslēpuma saturs ir neatbilstošs, jo tā tvērumā neietilpst ziņas par klientu un saistībā ar to, kuras klients iesniedz bankai uz likuma vai līguma pamata, vai kuras likumā noteiktā kārtībā banka iegūst pati. Neizpaužamo ziņu satura tvērums atšķiras no bankas klienta noslēpuma satura, tādējādi radot ietekmi gan uz klienta ziņu, gan bankas tiesisko aizsardzību, īpaši gadījumos, kad bankai rodas pienākums ziņas izpaust uz likuma pamata. Maģistra darba mērķis ir analizēt bankas klienta noslēpumu, tā saturu kontekstā ar bankas likumā noteikto pienākumu atklāt neizpaužamas ziņas, kā arī materiāltiesiskos un procesuāli tiesiskos aspektus saistībā ar neizpaužamām ziņām un to sniegšanu. Darba uzdevums ir uz veiktās analīzes pamata rast iespējamos risinājumus tiesību normu nepilnību novēršanai.

Content of the bank’s client secrecy stated by the Credit Institutions Law is inappropriate as its scope does not include data the about the client and data in relation thereto which the customer submits to the bank on law or contract basis, or the bank obtains itself in accordance with a statutory procedure. Non-disclosable information contents scope is different from the bank’s client secrecy contents thus affecting both the client's data, and the bank's legal protection, especially in cases when the bank becomes obliged to disclose the information on a legal basis. The aim of the Master's paper is to analyze the bank’s client secrecy, its contents in the context of the bank's statutory duty to disclose non-disclosable information, as well as the substantive and procedural legal aspects in relation with confidential data and its disclosure. The task of the Master's paper is to find possible solutions on the basis of analysis to eliminate legal shortcomings.
