Pašvaldību kompetences reformas aktuālās problēmas.

Abstract

Maģistra darba tēma ir “Pašvaldību kompetences reformas aktuālās problēmas”. Kopš Latvijas Republikas neatkarības atjaunošanas joprojām nav skaidri nodalīta valsts un pašvaldības kompetence, kas praksē veido neskaitāmas problēmas gan funkciju izpildes īstenošanā, gan atbildības noteikšanā. Precīzi noteikts funkciju sadalījums sekmē tiesisko noteiktību un stabilitāti valstī, tāpēc ir uzskatāms, ka šie jautājumi ir aktuāli, kas līdz šim ir maz pētīti. Maģistra darba mērķis ir veikt padziļinātu pašvaldību funkcionālās reformas izpēti un analīzi, kā arī aplūkot šobrīd esošo pašvaldību funkciju problēmjautājumus un sniegt to risinājumu. Mērķa sasniegšanai tiek pētīts: 1) pašvaldības kompetences institūts; 2) Latvijas pašvaldības kompetences vēsturiskais un mūsdienu juridiskais regulējums; 3) pašvaldības kompetences izmaiņu doktrinārais un juridiskais pamats. Pētījuma rezultātā tiek konstatēts, ka normatīvo tiesību aktu regulējums ir neprecīzs un nekonsekvents, kas praksē rada nevienveidīg

The topic of Master thesis is “The current issues of competence reforms within self-government”. Since the Republic of Latvia regained its sovereignty, there has still been no clear division drawn between the state and the self-government competence, which in practice is causing numerous problems both in implementing the function performance and determining the responsibility. Exact division of functions encourages legal certainty and stability in the country, therefore it shall be considered that these issues are current, which have been little researched so far. The goal of the Master thesis is to perform due diligence and analysis of the functional self-government reform, as well as review the current problem issues of the self-government functions and provide solutions to these.
