Mantojuma apgrūtinošo saistību pieteikšanas termiņi

Abstract

Mantojuma tiesības regulējošos normatīvajos aktos pastāv nepilnības attiecībā uz mantojuma apgrūtinošo saistību pieteikšanas termiņiem, kas praksē rada nenoteiktību šo saistību apmierināšanas prioritārajā secībā. Pētījuma mērķis ir analizēt mantojuma apgrūtinošo saistību pieteikšanas termiņus un piedāvāt risinājumus nepilnību novēršanai normatīvajā regulējumā. Līdz ar to darba uzdevumi ir veikt tiesību normu un vēsturiskās attīstības izpēti, analizēt teorētisko informāciju un izpētīt dažādu mantojuma apgrūtinošo saistību veidu pieteikšanas termiņu savstarpējo saistību un ietekmi uz mantojuma apgrūtinošo saistību apmierināšanas secību. Rezultātā tiek piedāvāti risinājumi nepilnību novēršanai, nosakot mantojuma apgrūtinošo saistību pieteikšanas termiņu ilgumu, apmierināšanas secību un jaunu tiesību piešķiršanu zvērinātiem notāriem.

There are deficiencies in regulatory enactments that regulate inheritance law regarding time-limits for declaring obligations that impose a burden on inheritance, which causes uncertainty of prior sequence of satisfaction of those obligations in practice. The purpose of this research is to analyze those time-limits and come forward with solution for elimination of deficiencies. Wherewith the tasks of research are studying the norms and historical evolution, analyzing theoretical information and finding out interrelation of various time-limits and its influence on sequence of satisfaction of those obligations. As the result solutions for elimination of deficiencies defining the length of time-limits for declaring obligations that impose a burden on inheritance, prior sequence of satisfaction and allocation of new rights to sworn notaries is offered.
