Vārda brīvības problemātika globālā tīmekļa vidē Eiropā

Abstract

Globālā tīmekļa straujā attīstība izaicina pastāvošos tiesību konceptus vārda brīvības jomā. Darbs ir veltīts izvēlētu vārda brīvības problēmu analīzei globālā tīmekļa vidē Eiropā. Tā ietvaros autors pēta globālā tīmekļa tehnisko īpatnību atsevišķu aspektu ietekmi uz vārda brīvību. Tāpat autors apkopo un analizē Eiropas Cilvēktiesību tiesas praksi par tiesībām uz vārda brīvību globālā tīmekļa vidē. Noslēgumā tiek secināts, ka globālajam tīmeklim piemīt sevišķa rezistence pret vārda brīvības ierobežojumiem. Neskatoties uz anonīmu aizskārumu risku, vārda brīvība globālajā tīmeklī ir jāaizsargā tikpat stingri, kā tradicionālajos medijos. Gan Eiropas Cilvēktiesību tiesas, gan Eiropas Savienības Tiesas praksē ir spriedumi, kuru dēļ tiek radīts pārmērīgs ierobežojošais vai atturošais efekts uz globālā tīmekļa medijiem.

The rapid developement of the world wide web challenges the existing legal concepts in the area of freedom of expression. This work analyses selected problems of the freedom of expression on the world wide web in Europe. The author examines the influence of selected aspects of tehnical characteristics of the world wide web on the freedom of expression. Besides the author summarizes and analyses the case law of the European Court of Human Rights regarding the right to freedom of expression on the world wide web. It is concluded that the world wide web is particularly resistant to restrictions of the freedom of expression. Notwithstanding the risk of anonymous insults the freedom of expression shall be equally protected as it is in the traditional media. The case law of the European Court of Human Rights and the Court of Justice of the European Union has judgements that have deterrent or chilling effect on the world wide web media.
