Darba ietvaros autore pēta, vai mūsdienu starptautiskajās tiesībās pastāv pamats runāt par valstu tiesībām īstenot iebrukumu citas valsts teritorijā, ar mērķi aizsargāt savus pilsoņus, kas atrodas nopietnās briesmās un kurus uzņemošā valsts nespēj aizsargāt. Tāpat autore arī analizē iespējamos tiesiskos pamatus principa īstenošanai un doktrīnā izvirzītos kritērijus principa īstenošanas tiesiskuma izvērtēšanai.
Autore secina, ka šobrīd nepastāv tiesību norma, kas pieļauj šāda iebrukuma īstenošanu, bet norāda, ka atbilstošākais tiesiskais pamats tam būtu ANO Statūtu 51. pantā ietvertā pašaizsardzība. Autore arī piedāvā jaunus divu līmeņu kritērijus principa īstenošanas tiesiskuma izvērtēšanai un pauž viedokli, ka saredz nepieciešamību šāda principa atzīšanai, neraugoties uz iespējamu tā piemērošanu pretēji principa mērķim. Whitinthe scope of this paper author is researching whether in contemporary international law does exist basis to talk about states right to intervene in other states territory to protect its nationals, who are in serious danger and cannot be protected by the host state. Author is also analyzing possible legal basis for implementation of such principle and criteria set out in doctrine to evaluate justified fulfillment of it.
It has been concluded that at the moment there exists no norm allowing enactment of such intervention, however the most appropriate legal basis would be self defence embodied in Article 51 of the UN Charter. Author proposes new two-level criteria for the evaluation of the justified fulfillment of the principle and gives the opinion, that the principle should be accepted despite the possibly wrongful implementation.
