Maģistra darbā ir apskatīta darba devēja uzteikuma regulējuma evolūcija no 19. līdz 21.gs. Latvijas teritorijā, kā arī tas salīdzināts ar pārējām Baltijas valstīm. Debates par Darba likuma grozījumiem ir aktuālas jau no Darba likuma spēkā stāšanās. Lai nepieļautu kļūdas kāda tiesību institūta pilnveidē, nepieciešams izpētīt tā vēsturi. Vēsturiskā skatījumā uzteikuma institūts nav saistījis tiesību vēsturnieku uzmanību. Pētot darba devēja uzteikuma evolūciju no 19.gadsimta, autors pārlūko juridisko literatūru un periodiku, izanalizē normatīvo regulējumu un izpēta tiesu praksi, kā arī identificē pašreizējās darba devēja uzteikuma problēmas. Rezultātā autors nonāk pie secinājumiem un priekšlikumiem Darba likuma pilnveidošanai. Tiek secināts, ka uzteikums ir ievērojami attīstījies un līdzsvaro gan darba devēja, gan darbinieka intereses un to ir iespējams pilnveidot, nosakot, ka darba devēja uzteikuma termiņš ir atkarīgs arī no darba tiesisko attiecību ilguma. Master’s thesis is dedicated to research history of notice of termination of employment, evolution of regulation in 19th -21st century in Latvia, comparing it to Baltic States regulation.The debates on amendments of Labour Law research are topical since Labour Law entry of force. To avoid errors in the improvement of the legal institute, it is necessary to research its history. Historical studies of notice of termination has not bound legal historians' attention.
Author explores the legal literature and periodicals, analyse the legislation, court practice in cases related to labour disputes, identify current issues, and comes to the conclusions and proposals for improvement of the Labour Law. The author concludes that a notice of termination has evolved significantly and balances both the employer’s and employee's interests, but it can be improved by providing that the notice period also depends on the length of service.
