Personas tiesības uz privātumu un datu apstrāde internetā

Abstract

Datu apstrāde nenoliedzami ir saistīta ar personas privāto dzīvi un saskaņā ar cilvēktiesību pamatprincipiem, nepamatoti personas pamattiesību aizskārumi nav pieļaujami. Internets ir radījis vidi, kur informācija un dati brīvi ceļo starp dažādām valstīm un tiem var piekļūt no jebkuras vietas pasaulē. Ņemot vērā ātrumu, apjomu, pārrobežu elementu un regulējuma atšķirības, datu apstrādes uzraudzība un kontrole ir kļuvusi gandrīz neiespējama. Darbs analizē datu apstrādes veidus, identificējot jomas, kas rada īpaši augstus personas privātuma aizskāruma riskus, kā arī nosaka esošā regulējuma nepilnības, sniedzot priekšlikumus to samazināšanai.

Data processing is undoubtedly linked to the person's right to privacy. According to the principles of human rights, interference with fundamental rights of an individual cannot be unjustified. Internet has created an environment where information and data flows freely across borders and they can be accessed from anywhere in the world. Taking into account the speed, the magnitude, the cross-border element and differences in regulation, the supervision and control of such data has become almost impossible. The findings in this paper identify multiple kinds of data processing that present extremely high risk for the breaches of person's right to privacy and evaluates the shortcomings in the current data protection regulation.
