Normatīvo aktu izstrādes metožu ietekme uz normatīvo aktu kvalitāti

Abstract

Maģistra darbs “Normatīvo aktu izstrādes metožu ietekme uz normatīvo aktu kvalitāti” aplūko normatīvo aktu kvalitātes jēdzienu, un tiesību akta izstrādes metodoloģijas ietekmi uz tiesību aktu kvalitāti. Darba mērķis ir izpētīt situāciju normatīvo aktu kvalitātes jomā Latvijā, salīdzināt to ar normatīvo aktu kvalitātes jēdzienu starptautiskā līmenī, apzinot tiesību doktrīnā minētās atziņas par tiesību aktu kvalitāti, noskaidrot, vai pastāv noteiktas tiesību aktu izstrādes metodes, kā arī analizēt, vai tās ietekmē tiesību aktu kvalitāti praksē. Pētījuma rezultātā autore konstatē faktu, ka normatīvo aktu kvalitātei kā elementam, kas veido efektīvu tiesisko regulējumu, netiek veltīta valsts pārvaldes iestāžu amatpersonu pietiekama uzmanība, kā arī sniedz priekšlikumus vienotas normatīvo aktu kvalitātes nodrošināšanas sistēmas izveidei un piedāvā normatīvo aktu kvalitātes sasniegšanas metodes.

Master’s thesis „Impact of normative acts’ development methods on the quality of normative acts” presents a review of the notion of normative acts’ quality, and the impact of methodology of normative acts’ development on the quality of normative acts. The objective of the thesis is to explore the situation in the area of nvormative acts’ quality in Latvia, to compare it to the notion of normative acts’ quality in international level, by examining the findings of legal doctrine on normative acts’ quality, to identify whether there are certain law-making methods, as well as to analyse, if they influence the wuality of normative acts in practice. As a result of this research, the author states a fact that he quality of normative acts, as an element of an efficient regulation, gets insufficient attention from the officials of state authority institutions. The athor makes proposals as well for establishing a united system of ensuring the quality of normative acts.
