Eiropas Savienības pievienošanās Eiropas Cilvēktiesību konvencijai ietekme uz cilvēktiesību aizsardzību dalībvalstīs

Abstract

ES pievienošanās ECK nozīmē pievienošanos citai starptautiska līmeņa kārtībai, kā rezultātā sistemātiski, specializēti un vienmērīgi tiks aizsargātas cilvēktiesības Eiropā. Darba uzdevums ir noskaidrot, kādā veidā Savienības pievienošanās ECK ietekmēs dalībvalstis. Ņemot vērā, ka tiks ietekmētas gan EST, gan Eiropas Cilvēktiesību tiesas lomas pamattiesību aizsardzībā, tad darbā tiks pārbaudīta pievienošanās tiesiskās un faktiskās sekas, akcentējot lielāko uzmanību tieši uz dalībvalstu ieguvumiem un zaudējumiem. Darbā tiks vērtēta gan ietekme uz pamattiesību tvērumu, grozot līdzšinējo EST un Eiropas Cilvēktiesību tiesas tiesu praksi, gan vispārīgo pamattiesību nozīmes un satura maiņa, dalībvalsts ietekmētais stāvoklis gan no ES, gan Eiropas Padomes puses, gan arī jaunizveidotie līdzatbildētāja un iepriekšējas iesaistes mehānismi, to ietekme un sekas.

The EU accession to the ECHR means accession to another international legal order, resulting in systematic, specialized and smooth protection of human rights in Europe. The aim of the study is to clarify the influence of the accession to on member states. Presuming that the roles of ECtHR and CJEU in the protection of fundamental rights will be influenced, this study examines actual and legal consequences of the accession, by emphasizing the most attention on the gains and losses of member states. This study will review the influence on the scope of fundamental rights, by changing the prior case law of CJEU and ECtHR, change of understanding and scope of fundamental rights, the affected member state’s status due to EU and the Council of Europe, as well as new co-respondent and prior involvement mechanisms, their influence and consequences.
