Laulāto mantisko attiecību jautājums Latvijas Republikas tiesību sistēmā nav sakārtots, spēkā esošo tiesību aktu normas ir pretrunīgas, pastāv laulāto mantu grupas, kā piemēram, laulāto atsevišķi iegūta manta, kas vispār netiek atrunātas tiesību aktos. Tiesu prakse ir ļoti pretrunīga, un Civillikuma normas, kas regulē laulāto mantiskās attiecības dažādos gadījumos tiek interpretētas atšķirīgi. Darba mērķis ir apzināt problēmjautājumus, kas saistīti ar laulāto kopīgās mantas nošķiršanu un rast risinājumu, izsakot konkrētus priekšlikumus problēmu novēršanai. Darbā risināts jautājums par atšķirībām nekustamā īpašuma piederības noteikšanā, izmantojot tiesiskās prezumpcijas – laulāto kopīgās mantas esamības prezumpcija, nekustamā īpašuma piederības prezumpcija. Darbā izvirzītas šādas laulāto kopīgās mantas nošķiršanas problēmātikas: laulāto kopīgās mantas sastāva un tās sadalījuma noteikšana, laulātā pierādīšanas pienākums par līdzdalību kopīgās mantas iegūšanā un laulāto tiesiskās attiecības ar trešajām personām. The question of property relations between spouses is not regularized in the legal system of the Republic of Latvia, the rules of legislation in force are contradictory, and there exist groups of marital property, such as a separately acquired property of the spouses that are not stipulated in the legislation at all. Judicial practice is very controversial, and the rules of the Civil Law governing property relations between spouses, in different cases are interpreted differently. The purpose of the work is to understand the problematic issues related to the division of marital property and find a solution through the expression of specific proposals to resolve the issue. In this paper the issue of differences in the establishment of affiliation of real estate is being solved through a legal presumption - the presumption of availability of the joint property of spouses, the presumption of affiliation of real estate. In this paper the following issues concerning division of joint property between spouses are set forward: the composition of marital property and determining its division, the burden of proving a spouse to participate in the acquisition of joint property and legal relations between the spouses and third parties.
