Bakalaura darba mērķi ir izpētīt cietušā tiesības,pienākumus ,atbildību, pirmstiesas kriminālproces,kā arī noskaidrot kā var iegūt cietušā statusu. Pievēršanās dotajai tēmai nav nejauša, jo temats visos laikos ir bijis aktuāls. Svarīgi ir arī tas,ka personai ir tiesības saņemt kompensāciju par radītajām ciešanām un zaudējumiem,darba mērķis ir izpētīt cietušā tiesības uz kompensāciju,cietušā tiesības uz pārstāvību un aizstāvību.
Ļoti ievērojama problēma ir tā, ka sabiedrībā ir liels neinformētības līmenis, ka personas, kas cietušas noziedzīgu nodarījumu rezultātā, nezin un neizprot savas tiesības, kā arī neprot tās izmantot savu interešu aizsardzībai, tāpēc cietušā vieta un nozīme kriminālprocesā ir un paliek viens no galvenajiem tematiem ne tikai Latvijā, bet arī citās Eiropas valstīs, ir svarīgi, lai tiktu ievērotas cilvēktiesības. This work presents the concept of a victim and its general characteristic, historical development of the concept of a victim and its regulation in criminal procedure of the Republic of Latvia
The purpose of the work is to study judicial position of a victim in a pretrial process presently, namely, to expose a place and role of a victim in this system.
The special attention is given to the right on reception of moral and monetary compensation and state compensation to a victim.There is analysed the way how the victim can receive compensation. Attention is given to the right of a victim,rights for judical help. the order how the victim can receive the juridical help provided by the state,also attention is given to study the duties and responsibility of victim in a pretrial criminal procedure. The common principles of the rights of a victim on the basis of norms of Criminal Procedure Law are analysed.The author look through the universal principles of the rights of victim; to analyse the changes in judicial norms going into an effect of a new Law of Criminla procedure; to expose the problems. This work consists of three parts.
